Case 5
After making a fortune, Baxter wearied of civilization and it’s luxuries. He moved to a South sea island paradise, There he lived in a thatched hut with a native bride. When he learnt that it was both legal and customary to have more than one wife, he ran up to his total to five huts and five wives. Finally the bliss wore off, Baxter quit his five wives and returned to the United States. There he died. His first wife promptly came to claim his estate - followed by the four others. A five-way lawsuit ensued.
"In the United States, a man can have only one legal wife", the first wife argued.
"As I was his first bride, under United States law I was his one-and only. His marriages to you four were illegal".
"Not so", Baxter’s four other widows retorted. "Under our island customs all five marriages were equally legal. That gives each of us, as much right to his estate as you have".
